Youn v. Mark Kim, et al
Plaintiff was involved in an altercation with employees at a body shop on September 21, 2023, and alleged physical injuries. Yoka Smith Senior Counsel John Park filed an MSJ in defense of an employee based on the improper attempt to pierce the corporate veil, and the fact that there was no evidence that the employee committed an intentional tort or negligence.
The Court agreed that that the defendant did not possess the requisite intent to be held liable for an intentional tort, that there was no evidence that alter ego liability applied, nor was there evidence that the defendant could be held liable for negligently hiring a tortfeasor employee. The Court therefore granted our MSJ.
