Garcia v. City of Los Angeles, et al.

    Plaintiff filed a lawsuit against Defendant Los Angeles Homeless Services Authority (LAHSA). Defendant is a government agency that provides services to the homeless.  Plaintiff was a homeless resident at a shelter and was bitten by a dog, owned by another homeless resident.  Plaintiff alleged a single cause of action for negligence  (statutory duty).   

    Defendant filed a demurrer  on the grounds that there are no statutes imposing liability on LAHSA to control the subject dog. The Court granted the demurrer without leave to amend.
