Angel Hernandez v. Fitness International, LLC
Plaintiff filed a lawsuit in Los Angeles Superior Court against Defendant fitness club, alleging personal injuries due to Defendant’s negligence and premises liability as a result of the collapse of a sauna bench.
Defendant moved for summary judgment on the grounds that there are no triable issues of fact where the express waiver of liability completely bars Plaintiff’s action, no notice to establish premises liability, and no evidence of gross negligence. The Court granted summary judgment in favor of Defendant on the basis of the express waiver of liability and that Plaintiff failed to raise any triable issue for trial.
