Damian Nassiri v. Forest Lawn Mortuary, Grace Community Church of the Valley, et al.

Plaintiff filed a lawsuit against Defendant Forest Lawn Mortuary and seven other defendants alleging wrongful cremation under Health & Safety Code § 7054.7, religious desecration, tortious interference with right to dispose of remains, wrongful death, and violation of the Elder and Dependent Adult Civil Protection Act under welfare & Institutions Code § 15600 et seq.

Plaintiff alleged that Defendant mortuary mishandled Plaintiff’s decedent’s remains. Defendant mortuary filed a demurrer to all causes of action as uncertain and based on a failure to state facts to constitute a cause of action against Defendant mortuary. The Court found that all causes of action were property subject to demurrer based on a failure to state facts sufficient to constitute each of them and sustained the demurrer without leave to amend.
